To be honest I don't even know if the judge decides the case at the end of the trial tomorrow or lets us know in a few days. I hope it is all over tomorrow though. Let you all know tomorrow :wink:

I've kept my mouth shut since suggesting a fighting fund, which, and I can understand why, you weren't up for.

I really think you will win this but, looking on the black side, if you don't, come back here before you pawn anything!

Well we really are now the unluckiest Jag owners ever!

After a fairly good day yesterday the judge asked to see the car first thing today. The car was clean and the damage was clearly visible from about 8 foot away but latter in her summing up she said that the damage looked of a minor nature and she could only see it close up :shock:

As soon as she saw the car her attitude towards me changed completely, like I was there wasting court time. The judge decided the two independant engineers reports, one obtained by the defence, that agreed with everything we had maintained were of little interest :shock:

She insisted that all the damage to the rear of the car was done 7 months before the incident with the dealer when the rear window was broken. Despite the two engineers reports stating that that was not possible and us insisting that that was not the case.
She said that we had not noticed the damage for 7 months and only noticed it at the dealers and then decided to get the car resprayed by claiming they did the damage. She also said we had a grudge against Jaguar because of the brake incident with this dealer and the past troubles with the first dealer we bought the car from.

I could go on and on but there is no point.

I will add two more thing and you make your minds up....

She asked the managing director of the dealership what he would have to do to the car to sell it on his forecourt, he said either a rear end respray or a full respray.

I think that implies some fairly extensive damage is on our car!

Whilst summing up she said that our car was in good condition and she could only see the damage whilst close up.


Have I lost the plot here :?: does a car in good condition need a respray to be sold on a dealers forecourt usually?


All of the defence witness's said the damage shown in the photos you all have seen was normal wear and tear.... :shock: The judge said it was down to the broken window. It was neither but she wasn't having it.

Very very odd summing up, didn't make sense to us at all.

They now want at least £15,000 in costs

Talk about a miscarriage of justice......

$hit - it looks as tho' there is little justice in this world. Did the judge use a white stick to get around?

The case was then dismissed and we now have to wait for a letter from the defence telling us the final total of costs that they want.

There is then a costs hearing where I can argue about the costs and try and get them down a bit. Of course I have no idea and no chance of being able to do that so probably won't even bother.

What can they do?? Make me bankrupt not much else. It's been a rubbish year financially so there is no money left to give them, not much left to put on eBay either so that's about it really.

In shock at the moment. Can't believe we have been had over like this.

Just have to say a huge thank you to everyone that has followed this disaster and offered kind and wise words over the last year.

Just shows you the good guy doesn't always win in the end.

Thanks mate

At least I will be able to get back on the forum properly now. I have been absent for many months because just coming here reminded me of the case and I was getting too stressed about it.

I missed all the banter, be good to get back into things here.

What did I miss?? :lol:
