Whether you like it or not, we are going to help. The very minimum we need to do is pay for some damm good advice for you at that costs hearing. Don't give up on that, however down you feel right now.

Fair warning - I am away from my PC for the next 4 days, but come Monday night, I want to transfer some funds to you. Dont' come over all English and decline - this is compulsory, not optional.

I am severely pi$$ed off on your behalf. We now need to start a MAJOR campaign to phuk this dealer over - every single newspaper/motoring magazine should be made aware of how they $hit on customers. And that's just the start. JEC and JDC should get letters, Jaguar World Mag should know, in fact anyone remotely likely to do business with them should know.

We can do this.

Problem is wilf that the dealer has been judged in court to have done nothing wrong so I can not now say anything against them. That would be libelous. Believe me I am p issed off about it but those are the rules.


I have have said all along that I can't take money from you guys, it is my cock up and it would be unfair for anyone else to suffer because of it.

I just hope this thread makes people realise what can go wrong and to take out the legal protection cover with their car or home. It is cheap and could save someone else going through what we have just had to endure.

Was this judge body repairer in a previous life because I have had cars for over 40 years & I would not be able to make the assumtions she has,also is she pychic in knowing that the damage was done before it went to the dealers,british justice sh*te.Anyway I am going away for a week but if you pm me with your address I will send a cheque to start off your fighting fund,regards Ian

I really truly am so so sorry. That really is absolutely (curse) ridiculous.
That most certainly is not the correct outcome.
A citizen's advice solicitor might be able to take this further for you as most of the evidence seems to be on your side and i don't understand how she can justify ignoring it all.

The decision is final I am afraid. The more we think about this tonight the more it beggars belief. All the evidence was in our favour.

Quick poll here.

Who amongst us would miss minor damage on their car for 7 months never mind the damage we have on ours???????

It just makes no sense any of it. Every half hour or so we remember something else from her summing up that is in-accurate or just plain wrong.

Yes indeed but she attributed it to glass damage and just said we never noticed the damage when the rear window was broken. Even though I checked closely for any damage when the window was broken 7 months before the real incident at the dealers.

It's just b loody ridiculous. What a system we have.

My mum phoned us and said she had just had her hair done.
She said tell her where the dealer is, she lives in the same town, and she would go over and put a brick through the windows. She was happy to go to the nick as her hair had been done.

Trevor - please re-read my last post.

You don't have a choice - funds WILL come to you. Now get the paypal account name posted up here. There is no need to work through this by yourself.

You may not be able to say anything about the dealer, but we can. And we know how to not be "libellous" about it - all we have to do is state the facts - the dealer brought in the legal big guns and ground down the little guy. For a Small Claims Court action to have been moved to fast track like this is a despicable act by the dealer, designed wholly to beat down an impecunious plaintiff. And we can say that, too. In fact there is a whole bunch of stuff we can say that is either totally factual or our own honest (non libellous) opinion.

That by itself should make anyone think twice about doing business with them - I wouldn't.

Let us know where the Judges decision is posted - they are always put up on the 'net these days.

You are not alone, and must not try to be that way.

wilf thank you. It actually went to the next level, multi track on the directions of an earlier judge. I wasn't happy but there nothing you could do.

I wasn't aware the decision was available on the net. I will ring the court tomorrow to get the details. I guess I get a hard copy at some point.

I meant to say earlier. It was like Rumpole of the Bailey.

I was sat there trembling. And there were the 10 defence witness's sat at the back of the room. And the defence had a barrister, a barristers adviser and a legal executive. So three of them against me.
Just like a b loody murder trial.

When I made a good point they ran off to the witness's to advise them what to say when it was there turn. Thought that was pretty unfair myself.
