I've refrained from posting in this thread to date, despite following it religiously for some months now, because I knew what you have just seen and did not want to throw water on your hope of winning. In truth justice is rarely given to the little guy despite the popular misconception. The judge will see all the defence lawyers, witnesses, etc, and assume that they must be correct to have gone to all that trouble. The fact her opinion changed sour so rapidly when the judge saw your car makes me wonder if there may not have been an element of 'oh well he drives a Jaguar' stereotype in there, and probably some degree of thinking you are a troublemaker (not having been there those are merely an assumption on my bahelf). I watched it happen to a friend, and see the same thing all the time.
It beggars belief that the judge decided all that damage was done by a rear window despite the extent of it being totally incompatible with that cause and (if I have read it correctly) engineer reports stating that it was not possible.
None of us will ever use that dealer again, and most will think very carefully before using any of their affiliated franchises, but we are small and for every one of us there are a hundred other customers who will still use them. The defendants know this full well -- they will be reading all these threats not to use them again and rolling their eyes whilst rubbing their hands together. Don't give them the satisfaction of bankrupting you too.
Please do take some time off this weekend to try and take your mind off of this stressfull week, and come next week give some serious thought to accepting the offer of financial help. I know it is hard to do, not the British way of doing things at all, and goes against your pride, but a number of people here want badly to help and not let the little guy get screwed over for any more in this case. Collectively we may only able to raise a few hundred pounds for you, or maybe a few thousand, but that's not the point. We are all members of this online community and many want to step in and help our friends when problems arrive to help us all enjoy our cars and the forums. The sense of community on our streets has disapeared but it still exists here at least. Whether it is with money, advice, or banter, we all contribute where we can, and that is one of the reasons this forum is such a great place to be.
I'm gutted for you Trevor, you've been screwed over in the worst way, but at least you know you did the right thing and have nothing to be ashamed of. Please let us know if the decision is posted on the Internet.
