I am absolutely stunned having just caught up with events.
I am totally wth Wilf, x dave and others, please allow us to raise a few quid for you.
Justice has clearly not been done and you deserve all the support you can get in my opinion.
My hat is off to you for pursuing this to it's bitter and unjust end, it takes a lot of courage to take this sort of thing on.

Hi everyone
Can I just say how very touched Debbie and I have been by the offers of support and the private mails that we have received. It is quite overwhelming.
I am shocked to read the stories of gadget12 and w.bishop, our case is brought some what into perspective when compared to losing your house.

But it's early days yet! Knowing this solicitors :cry:

I have thought long and hard about accepting the kind offers of help from everyone here and dearly want to decline but having spent our last savings and borrowed money from both our parents to fight this case I think I have to swallow my pride and accept the offers.

Anything at all will go to help pay for a costings expert to try and get the 15 thousand pounds costs bill down. I am hoping to arrange to pay it monthly but suspect this lot will be out to finish me off. A bit of a shame as that will finish my ambitions of being a fully qualified driving instructor. I just have the final exam to sit after training since last year. Had to have a break from it the last two months due to stress and the pupils I had went to other instructors within the company.

That web address was very interesting, the poor guys car. What a poor response from the dealer. Surprised????

I will be checking with the court on Monday to see if there is an appeal process. I understand that there isn't but will double check. I'll be checking to see if the judges findings are also published. As it was an open court it is a matter of public record I would think.

After a long chat with the Northampton County Court and the High Court of Appeal in London it would seem that an appeal is only possible if the judge has said so in her final order. We won't know that until we are sent a hard copy of the decision. The decision is not freely available on the net but there seems to be a website where you can pay to read the court documents at £8 a time :shock:

If the judge will let us appeal we would have to pass it all to a solicitor and pay the fee's and solicitors costs. To ask the judge for permission is £200 if she says no that is that. If it's yes then it all goes to the high court in London. Where you have to prove that the judge was wrong and ingnored key facts etc. Sounds complicated and very expensive and is probably going to take a year or more.

Health wise it may be better to accept being screwed over and move on....

So let me recap this from the pages I've read....

Dealer has car. Pressure washes car and bungs it up. Experts agree car was wrecked by washing.

Courtroom drama(s) ensue. Judge sees damage and thinks it's trivial and makes you pay the dealer's court costs in excess of 15,000 pounds?

My country follows British Common law (Canada) and in small claims court you can't ask for court costs. I'm just floored it got to this.

Small claims court is the last sanctuary of the average man. I'm guessing this was taken to a higher court?

That's pretty much it Cosworth. We started a small claims action and you do not pay costs if you lose but because of the amount of the claim a judge moved it to the fast track. Because the defence wanted half the dealership to be witness's, they had 9, a later judge was forced to have the trial over two days, and moved it to the multi track, and in this court you do have to pay costs if you lose. I am quite sure the defence team knew this and did all they could to get it there!

Wilf, I am incredibly grateful to you and others. I was not expecting that level of support :shock:

I have to wait for a hard copy of the judges ruling and then I will make an appointment with the solicitor. Might take a week or two. I will ask about an appeal at the same time and see what the solicitor says.
